Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Incyte Realty Events platform (the "Service"), operated by Incyte Realty ("Incyte Realty", "we", "us", or "our"). By using the Service — whether as an event host or as a guest responding to an invitation — you agree to these Terms.

Who We Are

Incyte Realty provides a web-based platform that event hosts use to create invitation pages, collect RSVPs, and send transactional communications to their guests. We act as a service provider to hosts; event content, guest lists, and messaging decisions are directed by the host of each event.

Use of the Service

• You must be at least 13 years old to use the Service.
• You agree to provide accurate information when submitting an RSVP or creating an event.
• You agree not to use the Service for unlawful purposes, to harass others, or to send content that is abusive, misleading, or infringing.
• You agree not to attempt to access, probe, or scrape data you are not authorized to access, or to disrupt the Service.

Host Responsibilities

If you use the Service as an event host, you also agree that:

• You are responsible for the accuracy and lawfulness of the event content you publish.
• You have the right to contact any guest whose phone number or email address you add to your guest list, and you have obtained any consent required by applicable law for that contact.
• You will honor opt-out requests (STOP replies, unsubscribe clicks) received through the Service or conveyed to you by us.
• You will not use the Service to send unsolicited marketing, promotional, political, or commercial messages. Messages sent via the Service must be transactional and directly related to the event.

SMS Messaging

The Service sends transactional SMS messages (such as RSVP confirmations, event reminders, and day-of logistics) to guests who have provided their phone number and opted in. By providing your phone number and checking the consent box on an RSVP form, you agree to receive these messages. Message frequency varies. Message and data rates may apply. Your Content

You retain ownership of any content you submit to the Service (for example, RSVP messages or event descriptions). You grant Event Engine a limited, non-exclusive license to host, store, and display that content solely for the purpose of operating the Service.

Privacy

Our Privacy Policy describes how we collect, use, and safeguard your information. By using the Service, you agree to our handling of your information as described there.

Third-Party Services

The Service integrates with third-party providers including Firebase (data storage), Twilio (SMS delivery), and SendGrid (email delivery). Your use of the Service is also subject to the applicable terms of those providers.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or fully secure. Message delivery depends on factors outside our control, including carrier availability.

Limitation of Liability

To the maximum extent permitted by law, Incyte Realty will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, or goodwill, arising from or relating to your use of the Service. Our total aggregate liability for any claim arising from the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

Termination

We may suspend or terminate access to the Service at any time, including for violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and governing law) will survive.

Changes to These Terms

We may update these Terms from time to time. We will post the revised version on this page and update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the Service will be resolved in the state or federal courts located in Cook County, Illinois.
